Terms and Conditions

This Acceptable Use Policy ("Policy") for TechCentre is applicable to all customers and users of the TechCentre Network. This Policy is a clear statement of what activities TechCentre deems unacceptable. Such activities, set forth below and throughout this Policy, are non-exclusive and are provided as guidelines to any and all users of our Network.

TechCentre may revise this Acceptable Use Policy from time to time without additional notice by posting a new version of this document on the TechCentre web site. Accordingly, customers and users should consult this document regularly to ensure that their activities conform to the most current TechCentre Policy. In the event of a conflict between any service agreement or other terms and conditions and this Policy, the terms and conditions of this Policy will govern.

BY USING ANY OF THE SERVICES OFFERED BY TechCentre, YOU AGREE TO BE AND HEREBY ARE BOUND BY AND MUST COMPLY WITH THIS POLICY IN ITS ENTIRETY.

TechCentre Guarantee

  • Like for like applies to same hardware, software and service types.
  • Existing fees will be compared on a "like for like" basis, from professional organizations.
  • Quotes will need to be provided in writing, stating hardware specifications and labour involvement.
  • The guarantee shall only apply if the exact same parts (hardware or software) can be provided by TechCentre.
  • Any promotional (fees or quotes) rates will be applied for a limited time only.
  • 14 day warranty covers the original fault that was reported, repaired and subsequently failed again.
  • 24 hour service is on a call out basis by ringing 01624 665859 (out of hours). The emergency service is exempt from the price guarantee.
  • This promotion is available for a limited time only and can be withdrawn at any time without notice.
  • In all cases the directors decision is final.

General Unacceptable or Illegal Use

The TechCentre Network may be used only for lawful purposes. Transmission, distribution, publication or storage of any material in violation of any applicable law or regulation is prohibited. This prohibition includes, but is not limited to, material covered by copyright, trade mark, trade secret or other intellectual property right or material that is obscene, libellous, defamatory, fraudulent, constitutes child pornography, an illegal threat or abuse or violates export control laws.

TechCentre's Network shall not be used in a manner that violates the rules, regulations and policies of any network, server, web site, database or service provider. TechCentre customers and users shall not use TechCentre's network to encourage conduct that would constitute a criminal offence or give rise to civil liability.

Copyright Infringement

It is TechCentre's policy to terminate in appropriate circumstances the accounts of subscribers and accountholders who are repeat infringers of copyright.

System or Network Security

Violations of system or network security are prohibited and may result in criminal and civil liability. Violations of system or network security include, but are not limited to, the following:

  • Attempts to circumvent the authentication procedures or security of any host, network, network component, or account to access data, accounts, or services which the customer or user are not expressly permitted or authorised to access.
  • Attempts to scan, probe or test the TechCentre Network or system with the intent to evaluate, detect holes or otherwise breach security.
  • Tampering with or committing intrusion into any part of the TechCentre Network or system, or using any of TechCentre's hosts, network components or system to intrude into or disrupt or impair the performance of any other system.
  • Intentionally or negligently injecting bad routing information, incorrect DNS information or similar false data into the Internet.
  • Using the system in a manner that encumbers disk space, processors or other system resources beyond that allowed by the specific type of account or making deliberate attempts to interfere with a service, overload a service or attempting to disable a host.
  • Transmitting computer viruses, trojan horses, cancelbots or other destructive programming code with intent to interfere with the operation, function or use of any service or system.
  • Other unauthorised use including, but not limited to, password cracking, defrauding others into releasing their passwords, denial-of-service attacks (sending packets with an illegal packet size, mailbombing, UDP flooding, ping-flooding, half-open TCP connection flooding, etc.).
  • Tampering or attempting to tamper with any scripts presented on web pages or configure a web page to act maliciously against users that visit that web page.
  • Forging any TCP/IP packet header or any part of the header information.
  • Unauthorised eavesdropping or data monitoring or filtering.

Email

Users are prohibited from engaging in improper use or distribution of electronic mail ("e-mail") over the TechCentre Network and the Internet. Sending unsolicited e-mail messages to individuals who have not indicated a willingness to receive such messages is prohibited.

Domain Name Registration

In order to comply with NOMINET's terms and conditions, customers and users also agree to comply with the terms and conditions of NOMINET.

Password and logins

If you subscribe to the TechCentre On-line services, you shall maintain the confidentiality of, and shall keep secret and protected from access by third parties, your logins, passwords and other confidential information relating to your use of Service On-Line (“Access Information”;). TechCentre and/or its group companies will have no liability to you for any action that TechCentre takes in response to the provision of correct Access Information. You shall notify TechCentre without delay of any loss or notification of or to unauthorised third parties of Access Information.

Usenet Newsgroups

Use of Usenet Newsgroups and messages posted to Newsgroups must comply with the charters or FAQs for those Newsgroups and all applicable laws. Customers and users are responsible for determining the policies of a given Newsgroup before posting to it and are prohibited from disruptive or abusive practices that otherwise violate this Policy. TechCentre reserves the right to take any necessary action to ensure Usenet Newsgroups available through the TechCentre Network comply with this Policy.

Customers and users shall not post via the newsfeed any solicitation for mailback to an e-mail address (including addresses of non-TechCentre users) with the intention of bypassing this Acceptable Use Policy.

Enforcement

Violations of this Policy may result in cancellation, suspension or termination of services or such other action that TechCentre may, in its sole discretion, deem necessary. The user is not entitled to indemnification in the event that TechCentre cancels, suspends or terminates services as a result of any violation of this Policy by the user. TechCentre reserves the right to pursue all remedies for violations of this Policy by customers and users of the TechCentre Network to the fullest extent permitted by law. In the event of suspected, alleged, or actual illegal activity, TechCentre may, in its sole discretion, notify or cooperate with applicable law enforcement authorities for potential civil or criminal investigation or prosecution.

TechCentre Obligations and Limitations of Liability

Notwithstanding anything herein to the contrary, TechCentre is not responsible for reviewing any data, documents, materials or information that enters the TechCentre Network. TechCentre neither controls nor accepts responsibility for the content of any communication, regardless of its origin, that is transmitted or made available to customers and users of the TechCentre Network. TechCentre expressly disclaims any responsibility for the accuracy or quality of information provided by third parties that may be obtained through the use of its Network. Notwithstanding, TechCentre reserves the right to remove any material that violates this Policy, could be potentially illegal or cause TechCentre to incur liability.

TechCentre DISCLAIMS ALL LIABILITY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF BUSINESS OR BUSINESS OPPORTUNITY, LOSS OF USE, ETC., EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW OR EXCEPT TO THE EXTENT SPECIFIED IN A WRITTEN OR ELECTRONIC AGREEMENT ENTERED INTO BETWEEN TechCentre AND THE CUSTOMER. TechCentre MAKES NO WARRANTIES OR REPRESENTATIONS HEREIN, EITHER EXPRESS OR IMPLIED, CONCERNING OUR NETWORK, AND EXPRESSLY DISCLAIMS WARRANTIES OF FITNESS FOR A PARTICULAR USE OR PURPOSE, THE WARRANTY OF SATISFACTORY QUALITY AND ANY OTHER WARRANTY IMPLIED BY LAW SAVE TO THE EXTENT SUCH WARRANTIES CANNOT BE EXCLUDED BY APPLICABLE LAW.

NOTHING IN THESE TERMS AND CONDITIONS SHALL OPERATE TO RESTRICT OR EXCLUDE TechCentre'S LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY ITS NEGLIGENCE OR ANYTHING ELSE FOR WHICH TechCentre CANNOT AT LAW LIMIT OR EXCLUDE ITS LIABILITY FOR.

Third Party Access

Customer is responsible for violations of this Policy by third parties having indirect access to the TechCentre Network through Customer or attributable to Customer's act or omission. Any such violations by a third party shall be deemed to be a violation by Customer, whether or not done with the knowledge or consent of the Customer or other third party. Customer shall have the sole responsibility to cease such violations and shall be solely liable for any loss, damage or expense arising from the third party violation of this Policy, including but not limited to, third party infringement of intellectual property rights such as the unauthorised or disputed use of domain names, trademarks or copyright protected works.

Indemnification

Customer agrees to defend and hold harmless TechCentre, its officers, directors, employees, agents, licensors, suppliers and its group companies from and against any and all losses, claims, damage and expenses, including attorneys' fees, arising out of its use of the TechCentre web site, TechCentre's Network and related services. Customer also agrees to defend and hold harmless TechCentre, its officers, directors, employees, agents, licensors, suppliers and its group companies from and against any and all losses, claims, damage and expenses, including attorneys' fees, arising out of any indirect access to the TechCentre Network resulting from an act or omission by Customer.

Complaints

Complaints regarding prohibited use or other abuse of the TechCentre Network, possible infringement, and violations of this Policy, should be sent via our contact page. Please include all applicable information that will assist TechCentre in investigating the complaint, including all applicable headerlines of forwarded messages.

Third Party Rights

You and TechCentre agree that this Policy shall not be subject to the Contract (Rights of Third Parties) Act 1999 and that no third parties shall have rights under these terms and conditions save where expressly required by applicable law.

Governing Law and Jurisdiction

This Policy shall be governed by and construed in accordance with the laws of England and Wales and you agree to submit to the exclusive jurisdiction of the courts of England and Wales.
